Is the battery charged to at least 50%, and preferably connected to the charging circuit?

Try again after the charge level reaches 50% +.

its at 40%

Charge to at least 60%....higher would be better.....and then try the update again.

See About Clearing Space:

I recommend having it at 40% clear, and 60% full --but, that's just me. As for all out there, if full, it's not going to update. So, see about clear space, especially System Data (see that bottom of this reply).

Troubleshooting iPhone Storage:

Internal storage cannot be upgraded. It is what it is. So, the maximum internal storage capacity never increases, even if you upgraded your iCloud plan. Learn More here: What's the DifferenceBetween Device Storage and iCloud Storage? Apple Support

Are you using Wi-Fi? Is it free of VPN and anti-virus?

What do you see at settings - general - software update? What is your current iOS level?

Updating an iPhone 13:

When it comes to updating an iPhone 13, you can do so using a Computer or though Cellular. With a Computer, you can use Ethernet; connect your computer to Ethernet, using an adapter (if required). As for Cellular, make sure you have to services to do so, as you'll be consuming lots of data.

Back Up First:

IMPORTANT: If you have an option to update, however, then be certain you backup your iPhone first. That way, you will have something to restore your iPhone from should anything go wrong with the update

“Same thing” … as what?

We have no clue, for example, what Apple Support told you when you contacted them. You did contact them, right? You said you did, as that was one of the many suggestions you were offered, and you said you tried each and every suggestion.
