When I try to update the Apple Tv, I recieve a message saying that the device cannot download the most recent update and that I should try again later. I have also had issues signing in to Netflix, but those issues seem to be unrelated.

well it is now August 21 and I still keep getting the "update has been unsuccesful" unfortunately.

Same here. Aug. 21, 2011. "The Apple TV "Apple TV" could not be restored. This device isn't eligible for the requested build." And, I'm trying to restore the version that iTunes grabs from Apple.
If it does nothing but show a blinking light.
Plug into PC with Itunes using micro usb cable.
Then Restore
I had the same problem, it constantly failed at the end of stage one. Disconnecting the network cable and using wi-fi solved the problem, it then worked first time
