Why are the subtitles doubled on iTunes movie purchases?

I just bought The Avengers and we've noticed the subtitles (for the parts where people are speaking another language) are doubled on top of each other. It looks like they are part of the movie (as expected) and it looks like the AppleTV is putting them on top of that in a shaded bar across the bottom. I've double checked my settings and Subtitles are turned off, so I wouldn't expect to see them. How do I turn this off?

I also got a refund for my purchase. However, the statement in the reply from iTunes support person about Apple looking into the issue and finding a resolution didn't sound that convincing. This is the exact information from the email that was sent to me this morning,

"I have submitted this item for investigation. Apple takes the quality of the items offered on the iTunes Store seriously and will investigate the issue with this item, but I can't say when or if the issue will be resolved. Please try again in a few weeks."

As for now, I am happy with the refund I received, and will try the download again sometime in the future.

The issue has been fixed. Just a simple redownload from the cloud is needed. Make sure you delete the copy in the itunes library before redownloading. Heres the email I got today:

Dear iTunes Customer,

Before downloading the new version, remove the current version:

3) Click the movie to select it, and press the Delete key.
4) Click Delete Movie and then click Move to Trash.

To download the new version:
1) Sign into the iTunes Store.
2) Click Purchased on the right side in the iTunes Store under the QUICK LINKS section.

I too had this problem on Avengers, including the subtitles remaining on screen after shift back to English dialogue.

Also had the same issue with another film 'To Rome With Love'.

I have an older Apple TV with HDD and get the feeling that might be the issue.

Although I got a refund Apple reminded me "Please note that this is a one-time exception, as the iTunes Store Terms and Conditions state that all sales are final" suggesting they will not refund future faulty products - this is obviously either an ATV or file issue!?

While I appreciate Apple might make, for example, 3d films available via iTunes in future and customers would have to take responsibility if they did not have proper hardware, Apple do not tell customers that films ate subtitled or warn us of potential issues - I therefore can't avoid this issue in all cases...
