I just bought Logic Pro 9. Logic Pro X released today. Can I get a free upgrade?

I bought Logic Pro 9 not even a month ago. I didn't know Logic Pro X was going to release today. Can I get a free upgrade to the new version?

Not officially no.. but you can always try calling Apple and see if they will do anything for you.

This is the response I got from Apple. This is unacceptable in my opinion. I will not let the matter rest!

I do understand where you are coming from, and I really am sorry about this. As much as I want to assist you on the refund of your current version of Logic pro, however it is not possible. Please be advised that Apple does not provide price protection or refunds in the event of a price drop or promotional offering or releasing a new version of an app.

I have also consulted a Senior Advisor on your behalf to explain the situation, and while Apple endeavors to provide the best quality products and services, I have been advised that iTunes Store will be unable to assist you further with this.

Yes.. the key thing to do it seems... is to CALL them and not email them..... as many people have already said in countless posts now.


However, as Pancenter noted in a different post and has been confirmed by one of my clients.. The App Store Reps have received a written notice from the 'Upper Echelons" that they should NOT issue refunds as per the EULA...


Having said that another of my clients called them this morning, having purchased L9 2 weeks ago.. and was given a refund after calling twice and spending an hour talking (politely but firmly) with a Rep... so it will depend on who you speak with ( and how yoiu sopeak to them.. which is equally important! Ranting and raving won't get you anywhere normally!!) ... and again,., the key is to CALL them and if at first, you don't succeed, try, try again... and hopefully you will find a sympathetic Rep who will still issue a refund for your L9 purchase so long as the purchase happened within a recent and reasonable timeframe. I believe that is considered to be 30 days..... in most instances.

They are a bit vague, but may give you some help in trying to get the money refunded.

I'm getting nowhere with Mac App Store. I'm a UK customer and less than happy, purchasing only 2 days before!!!


For customers who haven't received a refund, I'd say your best bet is to try submitting feedback via http://www.apple.com/feedback/logic-pro.html and http://www.apple.com/feedback/itunesapp.html. Hopefully if there's enough complaints, Apple will come to their senses.

Just to clarify a few things


I have a client who did receive a refund and is resident in the UK. However, that was two days after the release of LPX. Since then I understand from two different sources (plus what Pancenter stated earlier in this thread) that Higher Management at Apple have issued a "policy' update to their Customer Service Reps (CSRs) staitng they are not to issue refunds. This policy 'update' applies to all CSRs no matter where in the world they may work and is not just limited to those in the UK. I believe however, that some CSRs in the USA for example.. did not receive this update until several days after the UK ones... which possibly explains why those in the USA continued to be able to obtain refunds for several days before that policy was 'updated'.


It has been said that the terms of the Mac App Store EULA clearly says (and to paraphrase) "No refunds... " but I have not found that to be the case. I have not found any terminology in the Mac App Store EULA that reflects this. There is some terminology in the iTunes Agreements that could represent this policy but again, it is not clear as to if this relates to Mac App Store licences.


If anyone would like to point me to the specific 'no refunds' terminology in the Mac App Store agreement or the section of the iTunes agreesments.. i would appreciate it.


There was a revision made to the iTunes Store EULA in Taiwan in June 2011, which explictly allows refunds during the first 7 days but this revision only applies to Taiwan Residents and no one else.


The revised terminology reads as so;


"You may cancel your purchase within seven (7) days from the date of delivery and iTunes will reimburse you for the amount paid, provided you inform iTunes that you have deleted all copies of the product. Upon cancellation you will no longer be licensed to use the product. This right cannot be waived."


Again, this revised terminology only applies to residents of Taiwan.


Finally, just a matter of fact... You are not buying an app from the App Store.. You are licencing a product. This being so, there are different legal rules in most countries that can and do affect/limit your rights to refunds.


Note: I am not a legal expert in any sense. I am simply stating my own opinons based on my own, personal experience and research... the experiences related to me by my clients... and others here and elsewhere.
