Not to worry. My husband has now defected to Samsung, having been told by a "genius" that it was a hardware issue and he'd need to buy a new phone (out of warranty; insurance doesn't cover; yada-yada-yada).

I'm due an upgrade but even though my phone works right now, how long for? And, despite several upgrades of iPhone/iTunes, I still can't sync music from iMac to iPhone (it's all apple after all?!).

Apple seriously need to get their act together.

TJBUSMC1973 - Well this discussion is about IOS 7 and it is the only IOS I have personally had a problem with. However, by your own admission, this has been an ongoing problem that Apple is obviously aware for quite a while. Yet it makes no effort to replace a WiFi chip that can withstand the rigors of APPLE'S Updates. Again, APPLE'S updates. Did Apple warn anyone that updating an iPhone may cause these heat and WiFiu problems? **** no. Yet you continue to maintain that Apple is not at fault at all and is, indeed, a generous benefactor by offering $200 fixes to $600 phones that the Apple IOS update caused the $600 phone chip to overheat.

A known problem not fixed in three updates and it's is the buyer's problem? Well, yes it is because Apple accepts no responsibility for costing Apple phone owners a bunch of money and headaches. But heat isn't the problem. Apple's lack of transparency and Apple's inaction are the problems.

Keep drinking the Kool Aid.

Apple provides a one year warranty on all iPhone 4S units, as well as the option to extend that by an additional year. If the unit is under warranty, Apple replaces it for free. How is this difficult for you to understand?

Additionally, it is a very, very low percentage of units that have the hardware defect. Lower than the average for smartphones in the industry. You got one of the few (percentage-wise) that have a defect. Them's the breaks, kid. Tough luck.

In previous posts, I've stated that I think Apple should be handling it differently. I personally think that Apple should replace the iPhone 4S units that have greyed out wi-fi (as long as that is the only problem with the device), for up to a full year after the warranty or AppleCare coverage expires. But that was never the point I was debating.

My point was the SOURCE of the problem. Hardware, not software. And you want to know why I'm trying to get people to understand that it's the hardware, and stop trying to claim it's the software?

Because if you blame the software, then you have no valid argument, because the terms & conditions of the iOS update (that you MUST agree to prior to installing it on your iOS device) make it very, very clear that anything that happens as a direct or indirect result of the iOS installation is the sole responsibility of the user, not Apple.

The legal terms of the operating system mean you can't claim an issue based on the operating system. However, if it's a hardware problem, then you have a slight chance at getting something out of it.

In short, blame the software, and you have no case.

Blame the hardware, and you might have a case.

From: https://discussions.apple.com/thread/4638071?answerId=24551640022#24551640022

i.e.: "If the wi-fi chip was defective from the very beginning, and only the process of an iOS update would create enough stress to reveal this defect, then there was no way for me to report this defect during the normal warranty period. No other operations on the iPhone created enough stress to reveal this defect, which was present all along. Therefore, because the device was defective from day of purchase, but there was no way for me to test for that defect, it was impossible for me to report it prior to it being revealed. The fact that it only revealed after the warranty expired should not infringe upon the validity of my claim."

If you will find manufacturer, who replaces phones for free after warranty, come back and let us know. I promise to be first, to buy their phones, tablets and everything else. Until then...

Or until Timothy wins his case...

Agreed. No manufacturer repalces smartphones for free after the warranty has expired, not as a general rule. In specific situations, maybe.

If you don't like the terms of the warranty, don't buy the product.

This is a wonderful discussion with you guys about smartphones. And warranties. And blame. Transparency? NO. Responsibility? NO. What manufacturer creates it's own IOS and virtually makes it impossible for phone owners/purchasers to avoid upgrades to the phone via the IOS that the company (Apple) created and imposed on the phone owner, knowing that upgrades created problems with three generations of IOS upgrades, without telling customers of the inherent probelms associated with the upgrades because it had NOT made a concerted effort to replace a WiFi chip that can withstand the rigors of APPLE'S Updates. Again, APPLE'S updates.? We are taliking the iPhone 4s (again... see topic). We are talikng, minus our babbling, roughly 64 pages worth of people in this one thread ALONE (do some Googling) that have had worldwide problems upgrading to APPLE'S IOS!!!! It has NOTHING, NOTHING, NOTHING to do with the warranty TJBUSMC1973. I appreciate your research. You have shown APPLE negligence through three (3) upgardes at least when my problem was with only one. fromsouth - I also participated in a class action suit about collusion of e-book publishers price setting that took 10 years. I got a check for $ 0.78 last month. But we were RIGHT. Apple would rather pay attorneys than face up to customers apparently. Must be cheaper to lose face than admit wrong doing. So keep drinking the Kool Aid. I liked the Apple poduct. I used it daily until it failed. I now have major reservations unless APPLE develops a bit of backbone and integrirty.

Aw, you're so sweet!

So, you got a $0.78 check from your last class action lawsuit.

Please, keep us up to date on the progess of your current class action lawsuit.

Read what I wrote. I, personally, think that Apple should do more. But, I agreed to the terms of the warranty when I purchased it. And so did you!

You're wanting to change the deal after it's been agreed upon. l think the last guy I heard of wanting to do that was kind of a jerk. Lord of the Sith and all that.

Lando Calrissian: You said they'd be left at the city under my supervision.

Darth Vader: I am altering the deal. Pray I don't alter it any further.

See? Only villians try to alter the deal after it's been agreed upon. Shame on you

I actually was under impression, that Apple settled that one to avoid court costs. Never admitting the guilt. But congrats on 78 cents. So where do we go from Apple? Who is going to replace our stuff after warranty?

You are the one responsible for replacing your out of warranty device.

You can always try using the script that I provided to try to convince Apple to grant you an out-of-warranty exception, and I wish you the best of luck on that.

It was not a class action lawsuit against Apple. It was price-fixing against some e-book publishers,as I stated. Nowhere here is anyone discussing warranty except you and TJBUSMC1973. That is because the problem stems from an IOS that, as TJBUSMC1973 so aptly verifies, has consistently and constantly damaged a consumer's product. Apple is obviously aware and made no effort to fix this manufacturing flaw while continuing to sell a flawed product. Apple also continuosly urged people to upgrade to new IOS develped by APPLE! You guys are constantly and consistently missing the point. No one is asking for a warranty replacement. People here want Apple to own up and admit it has sold a flawed product and do whatever necessary to give relief to its customers so that the phones work as advertised. The posts here echo the frustration of the Apple customers who have invested a bunch of money for a useless product rendered useless by the Apple IOS install. And your response is always "it is covered under the warranty". OK, go work at the Genuis Bar becaise that is also the response there. But unless you actually have a solution to the topic "wifi doesn't work with IOS 7" I think your warranty drivel has run it's course and you can go input some other forum.

I also wish he would stop banging on about the warranty. My phone was covered for two years under EU law, except when the store sent it off to be repaired, the apple repair center claimed that it was ineligible as the phone had been opened by someone! I bought it brand new and never opened it myself (in which case it must have been them). Blatant lies to avoid repairing or replacing the device! It's also hard to prove the phone wasn't opened when they have just opened it. So the warranty hardly counts for much!

Last Thursday my wifi connection started to get issues for the third time. Luckally I have a two year warranty. I bougt my white iPhone 4s 32 GB in October '12, and in December '13, I encounered my first wifi issue with the greyed out wifi, and no bluetooth, after upgrading iOS. A part was replaced (I don't know which one) and it was sent back to me. It worked fine until march '14. After upgrading the iOS, a few days later the same issues started again. But this time only wifi was affected. I still had bluetooth.

Again my iPhone was repaird by replacing a part (I still don't know what part). And it worked fine until last Thursday.

As with the second issues, my wifi connection was irragular, and my iPhone frooze trying to go throught the menu in order to switch off and on the wifi connection. For about 20 to 30 seconds I only had a blank screen, and then the wifi menu appeared. This time however, I didn't upgrade to iOS 7.1.1 yet.

I'm sending back to the shop where I bought my iPhone. I hope they will replace it this time.
