Purchase Aperture without 10.9
Is it the case, that I can now only purchase Aperture if I have already upgraded to OSX 10.9?

This is most exceedingly annoying. This is why I run dual boot with Windows 8 on Macs, because of stuff like this. I had a MacBook Air that ran Aperture, the one program that I really liked on the Mac side of the machine. I gave the Air to my son for college, figured I'd rev up an older Macbook 4,1 I had with an SSD and more memory. It won't run 10.8, but I figured I could re-download Aperture and use it, the machine is perfectly capable of running such a program, with the SSD and memory it rocks.
But NO, i can't. I've paid for Aperture, and now its trash. Unless I buy a new Mac, which I am not about to do. So I will learn to like Lightroom I guess, although I'd prefer to use Aperture, FOR WHICH I HAVE ALREADY PAID.
