Dude, i guess mine and your problems are quiet the same... I have the same problem since I purchased the phone (as second hand iphone 5s). But the time when I discovered it, it was too late to go back to the seller to argue... The only solution I came upto, the best and easiest alternative for silent pictures can be taken during recording a video. There's an option to take a photo during the video...hope this may help you...
