Check Settings>General>Restrictions. See if you have anything restricted. If not, then the App Store is on the phone somewhere. Look on all the pages and in all the folders. If all else fails, go to Settings>General>Reset>Reset Homescreen Layout.
that is a good thought because i did have a passcode for awhile, but ended it, too much of a hassle, but i didn't remember it anyway. I did a factory restore, gave me back my app store icon and got rid of icons i no longer wanted, so that's good, but now i have to figure out how to get my contacts/messages from my iTunes/iMac backups :O

Let me help you with this.
If you restored to factory settings as you should have done, the contacts/messages are not available for you to use from any iTunes backup.
As Meg said earlier, they would have had to be backed up some other place in order for you to recover them. If you attempt to restore them from any iPhone backup, you will re-introduce the restrictions issue that got you here in the first place.
