Apple Sold me a Defect I-phone 6 & Not Being Responsible for it

Hi, I'm the first timer here.

I'm experiencing possibly the worst thing could ever happen to the i-phone 6 customer.

My I-phone is only 1 month old.


So I bought i-phone 6 last month from the official apple website & I received it from UPS.

From the day 1, I could not update IOS from my phone, even when it was fully charged. I tried to update several times, but it all failed.


Recently IOS 8.4 came out, so I tried to update again, but this time from I-tunes on my computer, not from the phone.

The update failed in the middle & gave me "Error 53". The screen turned black & it only shows it needs to connect I-tunes.

I tried to do the recovery with I-tunes, but the recovery failed in the middle.


So I took it to the Apple store in Soho, and they told me the phone was modified (which I did not) & they cannot give me any support, which is ridiculous.

They told me there is no way to prove that I did not modify it. It's ridiculous because they sold me the one already had problem since day 1 & I cannot get any support from them. How can they be so sure the one they shipped to me did not have any problems?


I even talk to the store manager & he told me the same thing. They recommended me to ship the phone to the factory & check.

I also did chat with Apple specialist, but he also recommended me to ship the i-phone to the factory to check.


Here is the problem about shipping back to factory:

Sending back to the factory can only prove whether the phone is modified or not, very likely. It's very high chance that they cannot prove that I didn't modify it.


So now I'm filling a compliment with BBB.

I hope I can get a refund or replacement soon, since I'm going to travel in a week & I probably cannot bring any phones with me when I'm traveling for few month.😟


To be honest, I'm deeply disappointed with Apple service. I spend so much money on it, even for the accessories.

Have anyone experienced something similar & solved it?


I'm looking for suggestions. Thank you in advance.

Send the iPhone back to Apple, or try dealing with a different Apple Store in the UK...in the past there were other users complaining about the SoHo store.

OK, it wasn't clear that this iPhone was purchased in the US and was taken in for service in the UK...the iPhone warranty is only valid in the country in which it was purchased. You will not be able to get service support in the UK for the iPhone. And Apple US will not accept shipment from outside the US so it must be brought back to the US and then handed over to Apple for support.

Okay, because she did not indicate the phone was purchased in the US and was trying to get assistance in the UK as it appears you posted in your thread here. The iPhone warranty is not international and never has been. As indicated in your thread here by many posters, and those living in the UK, Apple UK will not do anything about the device. If the device was purchased directly from Apple as it appears your wife indicated, then it would have to be dealt with in the US with Apple.

It seems she reports the device was taken to the Apple store in SoHo and they stated that it had been tampered with. I'm not sure if you discussed this with the manager of the store. If you did and did not receive satisfaction, then your next alternative is to call Apple Care and ask for a supervisor. Explain the situation and try from there. I don't know that a BBB complaint is going to make things better. As I indicated in the other thread, the time frame makes it harder to defend that nothing was done to the device, but you have to plead your case to Apple. But it has to be done in the US if that is where the device was purchased.

Yes, I did discuss with the store manager, but he only told me they cannot do anything to it because the phone was modified & that's their rule.

I also did a chat with the senior adviser, but he was basically recommending me to ship it back to factory.


Ok, I will try to talk to the supervisor. Thanks for the suggestion & I'll keep updating.

I just talked to the supervisor (same as senior adviser), but the same result.

They want me to ship it back to the factory, which is a very highly chance that they won't be able to prove who modified it/ try to get more money from me for service fee etc, like other people were complaining on the other board.


This is so unfair. The worst nightmare you can possibly imagine.

They sold me the defect i-phone & because it's after 14 days, I cannot even get a refund. I just threw away $700 for nothing.

It took me to figure out it's a defect phone in 30 days & it's too late? And who sent me the defect i-phone in first place anyways?


This is so wrong.😠

Why are you so reluctant to send it back to the factory to be checked. What is the worse that could happen? They would send it back and not repair it. You will not be able to attempt any better satisfaction unless you return it. Before I go further, I am guessing here that you ordered the device directly from Apple on their online store? If so, then return the device to Apple with a letter explaining that you ordered the device from them, you attempted to update the device and it failed. Then you are told that it appears to have been tampered with, however you have never had anyone else handle the device. However, if you ordered this from somewhere other than Apple, then that could be where your problem arose, and you would need to deal with whomever you ordered the device from.

I ordered it from the official Apple website.


I've seen people complaining that extra fee occurred in the process & did not success.

Sending back will be my last option to do, but I'm actually not afraid to do it. I just think there is something I can do before sending back.


Btw, Chris, are you working for Apple? You seem to be like very active in this forum... Just wondering.

No, none of us work for Apple. We just enjoy helping here. I don't know what else you could do before sending it back. You have already dealt with the store manager. I guess you could try another store, explain it to that manager and see if they can explain to you why it is believed the device has been tampered with. Otherwise you are going to have to deal with Apple directly.
