Apple Sold me a Defect I-phone 6 & Not Being Responsible for it

Hi, I'm the first timer here.

I'm experiencing possibly the worst thing could ever happen to the i-phone 6 customer.

My I-phone is only 1 month old.


So I bought i-phone 6 last month from the official apple website & I received it from UPS.

From the day 1, I could not update IOS from my phone, even when it was fully charged. I tried to update several times, but it all failed.


Recently IOS 8.4 came out, so I tried to update again, but this time from I-tunes on my computer, not from the phone.

The update failed in the middle & gave me "Error 53". The screen turned black & it only shows it needs to connect I-tunes.

I tried to do the recovery with I-tunes, but the recovery failed in the middle.


So I took it to the Apple store in Soho, and they told me the phone was modified (which I did not) & they cannot give me any support, which is ridiculous.

They told me there is no way to prove that I did not modify it. It's ridiculous because they sold me the one already had problem since day 1 & I cannot get any support from them. How can they be so sure the one they shipped to me did not have any problems?


I even talk to the store manager & he told me the same thing. They recommended me to ship the phone to the factory & check.

I also did chat with Apple specialist, but he also recommended me to ship the i-phone to the factory to check.


Here is the problem about shipping back to factory:

Sending back to the factory can only prove whether the phone is modified or not, very likely. It's very high chance that they cannot prove that I didn't modify it.


So now I'm filling a compliment with BBB.

I hope I can get a refund or replacement soon, since I'm going to travel in a week & I probably cannot bring any phones with me when I'm traveling for few month.😟


To be honest, I'm deeply disappointed with Apple service. I spend so much money on it, even for the accessories.

Have anyone experienced something similar & solved it?


I'm looking for suggestions. Thank you in advance.

Send the iPhone back to Apple, or try dealing with a different Apple Store in the UK...in the past there were other users complaining about the SoHo store.

[Solved]


Taking to the different Apple store for 2nd opinion worked for me, even within in US. So, thank you, Ralph for the suggestion.

After more detailed examination at the 2nd store, they found out it was actually a factory defect & I got a replacement in the same day.


Like you said, Soho store IS really bad. Their technician did a wrong examination & everybody had to believe his notes. The store manager was also very rude & bossy. Anyways, the nightmare is over.


I hope this helps for anybody having the similar issue.


Few suggestions:


Don't take it to Soho store if anything happens to your Apple products; They will try to fu-- you up even if you are an innocent user.

I went to the store on 5th Avenue in Manhattan which I found better reviews than other locations, so you should give a try.

Don't send the item to the factory immediately because I've seen people complained about get over charged even more.

Arguing with the senior adviser does not work because they are like robot & have to follow their rule; in this case, because of the engineer's note, they could not do anything.


You can also file complain through Paypal, BBB, Department of Consumer Affair etc. if none of above works.


Everybody including people working in Apple need to understand that there are more defect products than before & they need to be more flexible about it; especially their quality dropped so much ever since Steve Jobs passed away. They also need to fire the bad engineer & manager at Soho store.


Anyways, it's solved.
