2009 macbook OS update

I pulled my old macbook out and the hard drive failed. Replaced the hard drive but when i used old back up the OS is only updated to 10.6.8. I tried to update but it say I need to be at 10.8 OS or better. I do not have the original disc.

what can I do? Any help would be great and I do not know why this is referencing and iPhone

If you can boot to 10.6.8 use Software Update at least once so you get special updates such as the "Mac App Store Update for OS X Snow Leopard" - https://support.apple.com/HT205702

The app will let you see what's available for you Mac from the Store. Anything after 10.6 was online only (okay, some nit-picker could mention Lion on USB).
