FedEx mailed me an empty box..

I was able to pre-order my iPhone 4 on day one and waited for it to arrive today. After signing for my package I walked into my house and realized the tape was broken on the box and nothing was inside the package. The FedEx was already long gone. I called Apple and they told me they would contact me back in 24 hours by email. I made sure the lady made a note that said I wanted them to call me.

She said they will probably mail me another iPhone but has no idea when. I was beyond ******. I asked if she can reserve me a phone in any store and I would pick it up tomorrow and she said that isn't possible.

It has been many hours and no one has contacted me. I also called FedEx and let them know about my problem. They promised to call the driver of the truck and the station he picked the package up from to locate my iPhone. They said they would call me back before the end of the day. It is now 9pm and no call.

I'm not exactly sure what to do. I can't believe I was delivered an opened package and the FedEx guy said nothing when handing it to me. I assume I'll have to wait till mid next month before they actually ship me one. Sigh.

That's because most companies haven't dropped 600,000 $600 devices into the channel at once.

I'm sure FedEx will prosecute each and every case where a perpetrator can be determined.

Unfortunately, in most cases, the Police won't care about a theft of "only" $600.

Well, my "stolen" iIphone sceneario is being taken care of by Apple so I have some advise to those experiencing the same thing.
1.) You need to be persistent and proactive in calling Appple. They will not call you.... You have to keep bugging them.
2.) You must get to Customer Relations and and get a rep that will handle your case from beggining to the end. That rep will become your advocate to both ATT and FED EX. I got one of those and he is working on my case.
3.) Apple initiated a refund for my original purchase. He said that Appple does not want their clients to have to wait for the FED EX investigation to clear up. They will get you replacement phone and will then deal with FED EX.
4.) After he initiated my refund he called (on a conference call) ATT and requested that my eligibility to purchase another Iphone was reset.
5.) He instructed me to go to the nearest ATT store purchase my new phone. Not the Apple store because now we have to work with ATT.
6.) He said to go directly to the manager, explain the situation, and make sure that they help me. He said "Do not take no for an answer". He also said to threaten the manager that if they do not help me I am to call the Apple rep on the spot and he will catt ATT directly.
7.) My eligibility was reset. I purchased my new phone. Refund on original order was processed by Apple right away.
Hope this info. helps anyone out there with the same scenerio.

That sounds like a speedy and smart way to get the new phone to you, but why havent they just offered that from the get go? It seems much easier for Apple to refund us, reset our plan with AT&T, and let us go pickup and activate a new phone at the store totally bypassing the shipping problems.

When I suggested something like this to the Apple reps they told me the inventory is different in the stores so that isn't possible...

cecoulter, one question I have for you though: what city are you in and how was the line/availability when you went into the ATT store? I live in Los Angeles and I imagine the phones are still hard to get. Did they first deny you then give you one after talking with Apple?

Keep hounding FedEx and you should also be able to contact Apple.com support section and request that they open a Tracer for the package and FedEx should be able to investigate the issue. Problem with this is ever FedEx location is owned by different individuals unlike a shipping company like UPS where it is one large international company or like the Postal Service. That fact is probably what will make to tracer process very slow.
