What do you see on screen? If it is asking for a passcode or showing the time it MUST be erased before you can begin pairing to your phone. The document I linked gives you two different methods to erase.

You need to use the Watch app on the paired iPhone.
Go to General>Reset>Erase Watch content and settings.

It doesn't say anything about an activation lock but I'm really not sure because I just purchased the watch on ebay.... I also am wondering if it is icloud locked, but it isn't asking for an icloud password... I'm stumped by it. I have spoken on the phone with Apple and they tried a few things but then told me I'd have to bring it in (which I don't want to do where I just purchased it used). So I just didn't know if anyone had anything similar happen to them. Thanks
Please see If you forgot your Apple Watch passcode - Apple Support which describes the exact steps. Note particularly the requirement for charger power, or the Erase option does not appear.
Mine is pretty much the same thing happening as alex_h1 describes here.
The watch is new to me so it’s not paired yet. The issue is that I cannot pair.
Is the activation lock disabled?
That's the issue of buying 2nd hand. Many folks end up with sculptures or paperweights.
