Removal of activation lock by owner. without Apple ID data/pass by me

A person from another country gave me a broken smartphone, I restored it in my country for my money, but there Activasion Lock. The owner knows about this, but does not want to give me his Apple ID data (because he is probably worried about his account), he is ready to untie the Apple ID but does not know how to do this without temporarily transferring data from the Apple ID. Can this person using iCloud.com > "Find my iPhone" without giving data/pass from Apple ID to remove from me Activasion Lock?
