okay so i had to get a new iphone bc my old one was freaking out and messing up... it was on the ios 14 beta. i backed it up onto my computer and trying to move all the stuff to the new phone but its giving me an error saying the new phone isnt up to date but it is. am i going to have to get ios14 on the new device for this to work.

Yes you are correct. Your backup was created while using iOS 14 BETA. Your new iPhone probably has iOS 13.x.x and therefore cannot use the backup file created by a newer version of iOS. If you need to restore from that iOS 14 Beta backup file then you will need iOS 14 on the new iPhone.
