I am unable to use the Apple Watch. The previous owner left the activation lock on.

The previous owner should have followed the steps listed in: What to do before you sell, give away, or trade in your Apple Watch, or buy one from someone else - Apple Support
None. If the previous owner won't help, then you have a useless device.
Activation lock cannot be bypassed. Its an Ant-theft mechanism. Return it if you can.
The previous owner did nor remove the activation lock and is refusing to do so.. what action can I take
