Recently upgraded to iPhone 12 Pro Max and photos randomly disappeared

I upgraded to the 12 Pro Max, and transferred all my data from an iCloud backup the day prior. Everything transferred fine. The next day all of my photos and messages randomly were deleted, everything else was still the same. I hadn’t touched any of the settings or anything. I restored my phone to factory settings and went back to the old iCloud backup from a few days prior off of my old iPhone, and when it restarted all my photos were still gone but the messages were back. The 12 Pro Max is running ios 14.2.1 and is up to date. I have photos being saved to my iCloud when you look at the iCloud settings.
