Anyone having trouble getting the Airpods Max spatial audio to work?

Just got the new Airpods Max yesterday but I'm disappointed that the spatial audio doesn't seem to work. I select the demo but other than adjusting the eq and volume levels of the demo music nothing happens. I turn my head and the music follows me as if it was still in stereo mode, I move the device around and again the music doesn't change as if the source is from the device. I've tried this with my Ipad pro, Iphone XS and Iphone 12 and I get the same thing: nothing. I reset the Airpods, but still have the same issue, I hope this is just a technical issue but so far spatial audio seems to be a case of the emperor's new clothes. Also it would be helpful if Apple could allow me to select the Airpods Max as a device but that option isn't available.

Just got a replacement pair and I figured out the problem: there wasn't one (not with the airpods anyway). When listening to the "see how it works" spatial audio demo I was expecting all of the sounds to sound like they were coming from in front of me (if I turn my head to the left all of the sound will be in my right and vice versa), what I didn't realize is that the cabasa/maraca(?) sound is the only sound in the demo that does this so sadly I returned a perfectly good pair of airpods maxs for no good reason.
