When you buy a new phone do you get a one year warranty and if your phone doesn’t work properly can you replace it with a new phone before the one year warranty?

Yes, assuming you purchase it from Apple or an Authorized Apple Retailer.

It all depends. Apple determines whether the issue is covered by warranty, which generally requires the malfunction to be caused by a manufacturing defect. If the warranty covers the problem, then Apple determines the remedy.
