It WAS an option which has been removed. My time machine pre dates Big Sur. So you are suggesting I ditch my hardware because apple choose to remove a feature in an ‘upgrade’?
GDPR sets forth fines of up to 10 million euros, or, in the case of an undertaking, up to 2% of its entire global turnover of the preceding fiscal year, whichever is higher.

Exactly. There is nothing anyone here can do to change that.
Yeah i've thinking for 15 minutes now and can't make a GDPR issue out of this haha
and I've really tried

Is is being reported at malware every few hours by NETGEAR Armor security. Even if it can’t do any harm in time machine, it is annoying to get the threat notifications constantly.
Under no circumstances should antivirus be scanning your Time Machine archive. For one thing, there is an insane number of files in any Time Machine archive. Scanning it would be a huge waste of resources and wear and tear on your drives. It would keep your computer busy and slow.
Furthermore, how did this “malware” get on the Time Machine backup anyway? Either the file was harmless to begin with, or the antivirus actually didn’t block when it installed itself in a place where it could do damage. And your antivirus only complains now, when it is harmless?
In that case just ignore it in TM. If you have to do a full install of the system and user data you'll know to rerun MalwareBytes to remove it if it comes to that.
However, I agree that that option was handy and should be returned to TM. Tell Apple what missing features you'd like restored or new features added to the system via Feedback - macOS - Apple.
in Big Sur there is no capability to delete items from the backup.
What told you it was malware? More than likely it was a false positive or Windows malware that cannot do anything on your Mac.
