if I buy the iPhone 13 pro max on the iPhone section for £43.70 can I still upgrade when ever I want or do I have to join the iPhone upgrade plan where the monthly price is £58.45. do I have to go on upgrade plan or not because the £58.45 is for extra things like apple care and stuff which I don't want

You could update whenever you wish, so long as you have paid off the iPhone. That does not provide you an upgrade option like the Upgrade Program does. Once you pay off the phone with the monthly payment option, you can trade it in for credit towards a new device.
