Invalid Date of Birth when creating a new AppleID
I have put in the correct date of birth, but get the following message:
You cannot create an AppleID at this time. Try again later.
The phone is from Amazon and is second-hand.
Any ideas?

I don't think the problem is activation lock. I don't think you would even be able to start creating an ID if activation lock was active.
I recommend you contact Apple and ask about that message. While you could check Apple's system status for possible system issues, sometimes "at this time" can be really open ended and a really general error. It's been 18 years sine I created an Apple ID but make sure you're entering the date correctly. Some people mix up the month and day entries.
Contact Apple. Click here --> Choose your country or region - Official Apple Support Select your country, then a product. If you don't see one that handles your issue then keep experimenting with selections until you reach one that gets you a chat session or a telephone call and get the representative to redirect you.

I thought it might be because the email address is associated with an existing AppleID,
Apple has yet to make a simple, comprehensive support document about email address re-use but there are many posts on the forums where people have not been able to use an email address for an Apple ID that has previously been used as an apple ID, or possibly not even if it was used for some other purpose such as a rescue email address.
E.g.: This Community Specialist statement: "When you go through deleting an Apple ID, it cannot be used again as an Apple ID"

If the seller cannot unlock Activation Lock for you, return the iPhone for a refund.
If this was not an as-is sale, and if the seller has disappeared, then contact Amazon about a refund, or seller feedback. Not about unlocking it.
A locked iPhone will never be useful to you.
We can’t help you unlock it. Amazon can’t. Apple won’t. Not here. Only the person holding the Apple ID associated with the Activation Lock.

Thank you for the replies. The phone is not locked, and the issue is with the email address. I'm trying to set-up a phone for my dad.
I thought it might be because the email address is associated with an existing AppleID, but when I ask for password reset, it says there are no accounts associated with the email address.
It is frustrating because I believe there may be an account with that email. I have now had to go through the hassle of creating a Gmail account so I can make progress, which is not ideal.
This shows that for no apparent reason Apple is refusing to allow me to use the proper email address.
Thank you, but the phone is not locked and is not the apparent problem. Apple do not like the 'correct' email address and have provided an unhelpful error message.
