Is this a used device? If so, you'll never get this off to it, until they log out of iCloud on it. The sis the site the seller should have used, prior to selling to to you: What to do Before you Sell, Give Away, or Trade In your iPhone or iPad - Apple Support. Have them perform as instructed there, including the iCloud logout.
