If you have the money to buy an iPhone 12 Pro Max, and you can find one in good condition for sale, yes, you can purchase one.
Note that the iPhone 12 Pro Max is now several generations old, so you are unlikely to find any new ones for sale. That means that you would be buying used – and you might run the risk of buying one that had not been properly prepared for sale, and that was still tied to the previous owner. (Or worse, one that was stolen and that the owner had Activation Locked.)
Apple does offer Certified Refurbished iPhones for sale – and it looks like, right now, they are selling a number of refurbished iPhone 12-family models (at least in the online U.S. Apple Store).
