New Pencil Pro will not attach

I bought an Apple Pencil Pro for my daughter. When she tried to attach it to her 11inch Ipad Pro (M4) it seems to connect with the magnet, but then when you let go of the pencil it swings down as if only connected at a single point and then falls off.

I reached out to support on the site and they told me I would just have to return it for a replacement. I did that, printing out a return slip and mailing it out. When I received the replacement, it is having the same issue.

My other daughter also has an Ipad 11 pro and an Apple Pencil pro. That Pencil attaches fine to both ipads, this one has the connection issues on both ipads.

Support on the site told me I would have to do the return via the site and couldn't bring it into a store. It seems like they sent back the same pencil repackaged? Is there something else that could be causing this issue? Do I just return it again and hope for the best?
