Is Apple gonna give me a Refurbished iPhone?

So last week my iPhone 15 Pro Max got a software issue which is probably due to the new software update, I just bought the phone about a month ago, Brand-new, no physical scratches/damages. The warranty was still over 325 days, I brought it to the Apple last week and just got an email for a "replacement", I'm wondering if they're gonna hand me a refurbished phone instead of a brand new one since they weren't able to fix a problem that was cause by their own system. The iPhone was in perfect and excellent condition when brought to the Apple Store btw.

Per apple’s warranty Legal - iOS Warranty Document Us - Apple

(ii) replace the Apple Product with a replacement product of the same model … that is new or comprised of new and/or previously used Apple genuine parts and has been tested and passed Apple functional requirements

You will be able to tell by the model number of the replacement phone. Your old phone did not have a Software issue as that would have been easily fixed with reinstalling iOS and cost Apple a lot less money to do then giving you a replacement device under warranty.

If the phone is replaced you will get a service unit. It may be new. it may be refurbished. There is no way for you or anyone at Apple to tell the difference.

Well according to the guy I spoke to at the Apple Store, it did. The phone all of the sudden restarted itself and the Apple Logo kept on blinking. It was tried to get fixed the same day I brought it, but it took way too long, so the guy decided to send the phone to their repair centre.
