No need to be confused. Currently the law that imposes fines on Google, Apple, and Microsoft has NOT been overturned. It has not been done by Congress and the Supreme Court has not ruled that an Executive Order can eliminate those fines.

The fines on those companies are only for new downloads in their App Stores, so you can continue to use a previously downloaded app or access TikTok on the web using Safari. There has been no permanent solution, so the future of TikTok is still in limbo.

For TikTok to become unbanned, I believe that either

  • ByteDance, Ltd. and TikTok must divest TikTok from direct or indirect Chinese Government control, as called for by U.S. law, or
  • Congress must pass a bill to change the law – whether that new bill is signed by Trump, or passed over his veto.

Note that the law went into effect 270 days before the ban did. ByteDance, Ltd. and TikTok were given some time to comply with the divesture provisions, in hopes that they would do so. If they had done so, I believe that TikTok would not have been banned.

If its banned then why in the heck do other people still have it on their phones if it’s banned they wouldn’t not be able to get on it either make it make sense

The answer is simple and has been provided many times, but I will try again.

  • The fines placed on both Google and Apple are for allowing any downloads/redownloads of TikTok in their App Stores. You are banned from downloading the app due to the fines Congress placed on both Google and Apple if they were to let you do that.
  • Any previous version will continue to work for now. The days are numbered, but until then they will still work because Apple cannot pull the app from a persons phone.

That should make it clear why you cannot download it and why other people can still use it for now, if they had it downloaded previously.

As of January 21, 2025, TikTok remains unavailable on the Apple App Store for U.S. users, despite President Trump's executive order delaying the enforcement of the Protecting Americans from Foreign Adversary Controlled Applications Act (PAFACA) for 75 days.

The executive order has provided temporary reprieve, but legal uncertainties and potential fines continue to prevent TikTok's reinstatement on App Store.

You can learn more ⇢ about availability of TikTok and ByteDance Ltd. apps in the United States.

Good luck! 👋🏼😉

That is what is required to remove the fines and nothing has been done about it. Until then both Apple and Google would be fools for violating the law. Despite what you heard it is all talk without action.

Where did you find verifiable evidence of that claim that would stand up in a court of law?

There are three issues:

  • The App Ban was a separate clause in the law, and was not mentioned in the executive order
  • The president’s executive order only covered the service, not the apps
  • It isn’t clear that an executive order can nullify a law; this is still a democracy of laws

What makes you think that posting to an Apple Support site is the answer? It may help to read the posts here so you have a better understanding why it is not available. Once you do that, then it will be clear that contacting your Congressional Representatives that placed fines on both Apple and Google for allowing it in the App Store may be more appropriate. Requesting a company to break the law and pay ruinous fines is not going to happen.

The 75 day moratorium set by President Trump expires April 5. So unless some deal is reached or the President extends the moratorium further, Tic Tok will be shut down again. The law banning Tic Tok was passed by the Congress, signed by President Biden, and okay’d by the Supreme Court. Only Congress can repeal the law and it shows no signs of doing so. Secretary of State Marco Rubio recently announced he thought a deal would be made before the April 5 deadline.

Bottom line? Unless a “deal” is reached Tic Tok will indeed by shut down for good this time.

My opinion is that there are some intense conversations going on behind the scenes. But China has remained steadfast in its refusal to sell Tic Tok to a U.S. entity. Irresistible Force meets Immovable Object. We’ll see what happens April 5 but get your Tic Tok affairs in order just in case.
