airpods pro noise cancelling just produces static noise on right side

When selected, noise cancelling or Transparency just makes loud static noise in right pod. I went to the Apple Store and they said BOTH pods faulty and need replacement! This has to be a firmware or hardware issue, and after a quick search this is a known issue on early AirPod pros! Battery deg I accept but although they are nearly 5yrs old I feel Apple are laughing as mine took too long to fail.
