Nope, in fact the AirPods Max have no Water Resistant rating when compared to the AirPods Pro 3 that has the IP57 Water Resistant rating.
Water resistant is in no way the same as Waterproof and any device with a Water Resistant rating is likely going to fail while waterskiing. Even with a water resistance rating, those tests are performed in controlled environments under specific conditions, none of which is comparable to waterskiing.

Apple says this about 3 and water skiing:
"Don't expose AirPods to high-velocity water, such as while water skiing.
I would think it an extremely bad idea to wear Airpods of any kind while water skiing.
That's not even taken into consideration that you cannot hear if a dangerous situation arises such as a jet ski coming up from behind you.

I would never advise to use anything that’s not specifically designed for water submersion.
Unless you want your expensive gear to be completely ruined or lost if it slips off your head, forget about it.

No, it's not. One, it might interfere with your ability to safely monitor your environment. Two, they are not waterproof.

Hello~ We have been over this in great detail. Your Apple gear as with most electronics do not play well with water. So for clarification please don’t use your Apple devices in humid or water environments unless you want to replace them.
