When I try to update the Apple Tv, I recieve a message saying that the device cannot download the most recent update and that I should try again later. I have also had issues signing in to Netflix, but those issues seem to be unrelated.

I was trying to update from 4.1.1. Is everyone here that is having the problem trying to update from 4.1.1? Seems some have no problem but everyone with 4.1.1 that tries to get latest update cant.

It already worked for me using iTunes / Hotspot Shield VPN, as then i was able to connect to a working update server.
One more thing of interest that can save you some time:
When you restore and it works, the download size of the update will be 318.8MB
When you restore and it does not work the download size of the update will only be 289.5MB

i finally got mine to work (i am in so cal), but i have no earthly idea why. i didnt do anything. the atv2 went into sleep mode and when i woke it up, the update thingy came up and i thought "what the heck, why not?" so i tried and it worked. but it had failed several times before this. maybe it was the turning off or sleeping thing that helped.
maybe i got sent to a different server, if that's even possible. i have no idea, i buy apple stuff cause its easy and most of the time it does "just work". the problem is that when it doesnt "just work" it really doesnt work at all, and non-geeks (i say that with the utmost awe and respect as a total computer illiterate) like me are stuck until it does.
i hope they get it up and working for everyone soon.
Still failed here in Oz even with Hotspot Shield - and now I cannot completetly uninstall Hotspot Shield, so don't use if I were you,
O.K., so I think I have it figured out. Like some users have mentioned, some of Apple's servers have indeed been updated and fixed. I tried the Hotspot Shield VPN and ended up with a NJ ip which apparently was still pointing me towards the east coast servers and the download kept failing. I kept connecting and disconnecting until I ended up with a San Jose, CA ip and the download worked like a charm.
My advice would be to try and get a CA ip. If they have updated the servers starting from the West Coast, it could take quite some time to replicate to the rest of the other servers.
Also in southern California, but unlike the last two users (who either got it to work or suggested a fix via CA ip routing), still does NOT work here either, yet.
I live in San Jose and it's not working (June 26th 1AM PST) so a CA ip isn't going to help :-)
Open DNS would not allow me to even visit their website!!
Enough said!!
Still not working in Germany - now since six days problems with the update - shame on you apple...
