Why does this matter when a company is willing to stand behind the product either way. You can't tell an APPLE refurbished phone from any new phone, as a matter of fact most are stock, just ear marked for refurb's .

If you are talking about a refurb from your carrier, that is totally different, yes that phone will look old and used.

Peace bro

As an example, the warranty on the Motorola Droid:

What Will Motorola Do?

Motorola, at its option, will at no charge repair, replace or refund the purchase price of any Products, Accessories or Software that does not conform to this warranty. We may use functionally equivalent reconditioned/refurbished/pre-owned or new Products, Accessories or parts.

Please note the use of the word "Products".

Sir again you can't tell a refurb from a new phone. Your reality has landfills of old electronics as well.

I hava refurb mac , time capsule , ipad , they all look emmaculate , with no problems. I know they are refurb because I purchased them that way.

As far as my statement about refurbs from your carrier, I still stand by that comment, maybe with HTC or some other carrier, but its my experience that those Iphone looks used. These phones are sold as refurb'd from carrier and is sometimes mixed with the idea of receiving a perfect refurb from Apple.

However, Apple doesn't have to offer any warranty at all, its not standard just courtesy.

Can you not read? "pre-owned or new". And it will be at their discretion, not yours.

The wording in Apple's warranty, is, by the way, very similar and yes, includes the word new:

If during the Warranty Period you submit a valid claim to Apple or an AASP, Apple will, at its option, ℹ repair the Apple Product using new or previously used parts that are equivalent to new in performance and reliability, (ii) replace the Apple Product with a product that is at least functionally equivalent to the Apple Product and is formed from new and/or previously used parts that are equivalent to new in performance and reliability, or (iii) exchange the Apple Product for a refund of your purchase price.

But, apparently, you'll have to learn everything the hard way. Buy a Motorola phone and enjoy.

Best of luck.

I'm with you. I am going thru the same problem. I bought my phone in May and a week after I bought it was acting weird. Refurbished is used! don't try lying to yourself. I bought a NEW PHONE and it was defective so I am demanding a BRAND NEW IPHONE! if you guys buy used, that is your problems, I don't! I buy new because I don't want someone elses germs and ear wax. If I wanted a used phone I could go buy it used from the beginning.

If you returned your iPhone a week after you bought it then it would have been replaced with a new one. If you are just now trying to get it replaced then it will be replaced with a service replacement model, which could be new could be refurbished (there is no way to tell). If you can return a brand new iPhone purchased within the past 30 days they will take it back and give you a new one. You are returning a USED iPhone.

You can call the BBB all you want, they will not take your complaint. Mr. Caspian 2012 may be able to read the fine print and consumer protection laws but he apparently is not capable of understanding them. Read the warranty for just about any consumer electronics and you will find the same statement that Motorola, Toshiba, HP, Dell, Nokia, LG, Samsung, etc. use. And they are all compliant with the Uniform Commercial Code (UCC). I have replaced two Motorola phones and both times they were refurbished. I've also had other electrical devices replaced and they were refurbished. All worked fine and I'm still using them with the exception of the Motorola phones.

I did have two instances, a coffee maker and a computer, that was still under warranty and was replaced with a new product. But that was because the model was discontinued and the company had no refurbished units available. They contacted me and replaced it with a newer model.

Piece of crap.
