I have to be dead first right? Article now doesnt specify this in what can be accessed.

i have to be dead first right? And how again is this verified before legacy contact has access to my icloud?

To request access as a Legacy Contact, you must have:

The access key that your loved one created when they chose you as a Legacy Contact
Your loved one’s death certificate
