From what I understand, (this from the developer's grapevine) Apple wasn't prepared for all the people demanding upgrades and a few people were lucky enough to have a recent Logic 9 purchase refunded so in essence Logic-x was free. A communiqué from the Apple main office at Apple nixed ALL refunds, you have to purchase Logic 10 at the App store price.

The problem with this exchange is it left users with a working version of both 9 and 10 while only paying for one, this goes against the EULA so Apple put a stop to it.

However.. If you're using email to discuss a refund...stop! I would call them directly.

Don't yell at me, I'm just passing info along and won't be upgrading anytime soon, if at all.

Yeah, but there is no telefon support in germany, I've called the main hotline, and they've told my to write an e-mail cause the software support is to poor to have a phone or something ... bla bla bla, it's really not fair that there are a few refunds for Logic Pro 9.

This is the first time in 6 years using Mac OS that I want something from Apple and they let me down, in my opinion they have to refund everybody who bought Logic Pro 9 with in the last 3 weeks! BTW: before I've bought Logic Pro I googled for Logic Pro X and there was nothing about it!!!

AND: A few years back I've bought Pro Tools 7 with MBox 2 and a month later they released Pro Tools 8 and I've got a copy of it, cause they made for everyone the opinoin who bought while the last 3 month before releaseing Pro Tools 8, and it wasn't an Update, it was a whole standalone DAW! So what about that EULA stuff??

I couldn't agree more, and I'm in the exact same boat. Purchased on July 2nd - after convincing myself that "surely I can get a upgrade if it comes out in the next month or so". Not the case. First was told by customer service that it should be no problem, then was told "no refund/upgrade" through e-mail and telephone support. I think this biased treatment toward some users is really disgraceful.

I'm hoping they're just going through the motions with this and that I'll be refunded soon, as it stands I'm extremely disappointed and have my doubts about using the app store in the future.

@Balu_19:

When I first wrote the german support, there was no response within the 24 hours, so I decided to try to reach out the the us support.

go to http://www.apple.com/support/itunes/contact/ chose "contact itunes support" on the next tap "purchases, billing, redeption" and "the topic is not listed", write down the issue, something like "just bought Logic Pro 9 now X is out", click enter and on the next page tell them in detail about the problem, when I've bought it and that you know that there are other people that with a refund!

I tried with apple support many times and they said it was not possible. This is what they said:

"Third party discussions and rumor websites have no validity with Apple's actual policy and terms of service. It's important that you understand that the truth is that the Mac App store does not have price protection or upgrade protection. This has been confirmed with Apple that these items are "not" eligible for a refund under current terms of sale."

Which basically translates to: no one got a refund and its all rumors.

Put me on the list for NO REFUND POSSIBLE. I bought LP9 on 6/29. I emailed/called numerous times.

I couldn't get anywhere when calling - they just told me I had to email Express Lane. No luck there as I kept reaching the same rep named Ramil. He gave me the typical canned answers. He even said he asked a senior advisor and no dice.

After stating he spoke to a senior advisor, he did say something interesting:

"I've been advised that all purchases in iTunes are a final sale and although it is occasionally possible to make an exception to this policy, the amount of time that has passed since these purchases was made prohibits us from refunding them. As a result, arranging a refund is something that we will not be able to facilitate for you."

I did not ask for more info here as I really don't want to deal with it any longer. I've emailed, called, and submitted feedback. Maybe Apple will listen and in time offer us the refund/discounted upgrade that those of us who purchased LP9 less than 30 days prior to LPX's release fully deserve.

I do know, however, that this is the kind of thing that makes you second guess your buying options.
